Terms of use
This is a translation for convenience; the German version (AGB) is legally binding.
1. Scope
These terms apply to the use of Split&Fly (splitandfly.com, “the app”), provided by Daniel Jacek Klein, Isaak-Kounen-Straße 10, 47906 Kempen, Germany (“I”). You can try the app without an account; by creating an account you agree to these terms.
2. What Split&Fly is and what it is not
Split&Fly is a tool for planning group trips: collecting ideas, comparing prices, estimating costs and splitting them fairly. The app only supports you with planning.
- I am not a tour operator and do not offer package holidays or linked travel arrangements.
- I do not broker bookings and do not conclude contracts for travel services on your behalf. Links in the app lead to the respective providers (e.g. airlines, accommodation, booking portals). Booking and payment happen there only; the contract is made solely between you and the respective provider, on its terms.
- I do not accept payments for travel services and do not pass customer data on to providers.
- The respective provider alone is responsible for services, cancellations, refunds, changes and complaints.
3. Account
Saving to your account, sharing trips and the AI planner require an account (sign-in with Google or with a sign-in link sent to your email address). You must be at least 16 years old. Keep your access secret; you are responsible for what happens through your account. Use is currently free of charge.
4. Prices, information and AI
- Prices, flight times, availability and other information come from the providers or are estimates and guide values (e.g. meals, travel to the airport, extra costs). They may be outdated, incomplete or wrong and may change at any time. Only the provider’s offer at the time of booking is binding.
- Suggestions by the AI planner are generated automatically and may contain errors. Check them yourself before booking.
- Travel advice (e.g. entry, safety, health) is a summary with links to official sources and does not replace advice. The information of the competent authorities is authoritative.
- Cost splitting is a calculation aid. How you settle up among yourselves is up to you.
5. Your content and fellow travellers
You are responsible for the content you enter or share (e.g. trips, notes, names of fellow travellers). Only enter other people’s data if they agree, and only share trips with people you want to give access to. Unlawful content, misuse of the app (e.g. automated mass requests, circumventing limits) and interference with its operation are prohibited.
6. Partner links
Some links are partner links and are marked as such in the app. If a booking results from such a link, I receive a commission from the provider; the price for you does not change. Order and suggestions do not depend on it.
7. Availability and changes to the app
The app is under development (beta). I strive for smooth operation but cannot guarantee it. Features may change or be discontinued. Keep important information (e.g. booking confirmations) yourself as well.
8. Liability
I am liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. In cases of slight negligence I am only liable for breach of essential obligations whose fulfilment makes use of the app possible in the first place, limited to the typically foreseeable damage. Otherwise liability is excluded. I am not liable for the services, information and terms of the providers the app links to.
9. Deleting your account and termination
You can reset or delete your account at any time in the account menu. I may block or delete an account that breaches these terms, and may discontinue the service with reasonable notice.
10. Changes to these terms
If these terms change, I will show you the new version the next time you sign in. You can agree to it or stop using the app with an account.
11. Final provisions
German law applies. If you are a consumer, mandatory provisions of the country in which you live remain unaffected. I am neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. Should any provision be invalid, the remaining provisions remain valid.
